License Fee and Payment Collection

1. Introduction

These Terms and Conditions govern the collection of license fees by the Agricultural Produce Market Committee (APMC), issuance of licenses for market business, and payment processing through third-party platforms. By applying for a license and making payments through our platform, you agree to these Terms and Conditions.

2. License Fee Collection

2.1 Eligibility for License

All market plot owners and commission agents wishing to operate within the market premises are required to pay the prescribed license fee to APMC.

2.2 License Fee Structure

The license fee amounts, payment deadlines, and other charges related to the issuance of the market business license will be communicated to applicants upon submission of their request.

2.3 License Issuance

Upon successful payment of the license fee, APMC will issue a valid license certificate to the applicant. This license will authorize the licensee to conduct business within the market area as per APMC guidelines.

3. Third-Party Payment Platform

3.1 Payment Processing

APMC uses a third-party payment platform for processing license fee payments. By using the third-party Payment Gateway platform, you agree to comply with their Terms and Conditions in addition to those set forth by APMC.

3.2 Payment Methods

Payment Gateway platform supports a variety of payment methods, including credit/debit cards, net banking, wallets, and UPI. You are responsible for ensuring that the payment method you use is valid and authorized.

3.3 Payment Confirmation

Payments made via Payment Gateway will be processed and confirmed by Payment Gateway provider. APMC will only issue the license after receiving payment confirmation from Payment Gateway platform.

3.4 Payment Disputes

In the event of a payment dispute, APMC is not responsible for any issues arising between the user and Payment Gateway platform. You must resolve any payment disputes directly with Payment Gateway platform.

4. License Validity and Usage

4.1 License Certificate

The license certificate issued by APMC allows the licensee to operate within the market area as per the guidelines and regulations set by APMC.

4.2 Validity Period

The validity period of the license certificate will be mentioned on the issued license. Renewal is required upon expiration.

4.3 Non-Transferable

The issued license certificate is non-transferable. It is only valid for the registered applicant (market plot owner or commission agent).

5. Fees and Taxes

5.1 Applicable Fees

Licensees are required to pay the prescribed license fee, including any applicable taxes, in a timely manner.

5.2 Additional Charges

Any additional charges or fees related to the license application or renewal will be communicated by APMC at the time of payment collection.

6. Compliance with Regulations

6.1 Market Guidelines

The licensee must comply with all APMC rules, guidelines, and local market regulations during the tenure of the license.

6.2 Revocation of License

APMC reserves the right to revoke the license at any time for failure to comply with market regulations or non-payment of fees.

7. Limitation of Liability

7.1 Platform Availability

APMC does not guarantee the uninterrupted availability of the Payment Gateway platform. If there are any issues with the payment processing, please contact Payment Gateway platform’s support team.

7.2 No Liability for Third-Party Service Failures

APMC is not liable for any damages or loss resulting from payment issues caused by Payment Gateway or any technical failures related to payment processing.

8. Privacy and Data Protection

8.1 Personal Data

APMC collects and processes personal information as part of the license application process. This data will be handled in compliance with privacy laws.

8.2 Payment Gateway Privacy Policy

APMC is not responsible for the processing of your data by Payment Gateway. You agree to adhere to Payment Gateway's privacy policy when using their payment services.

9. Modification of Terms

APMC reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to licensees and updated on the APMC platform.

10. Governing Law

These Terms and Conditions are governed by the laws of PATAN, and any disputes will be resolved in accordance with the jurisdiction's laws.
